Estava lá eu, um jovem advogado (ou advogado jovem, como preferirem), na primeira semana de exercício laboral. Por uma conjuntura de fatores, pude ter o privilégio de ingressar em um escritório parcialmente estruturado, o qual me permitiu – com total autonomia – me dedicar exclusivamente à seara que elegi como minha, a criminal. Essa oportunidade me permitiu, ainda, exercer a atividade profissional com relativa facilidade operacional, vez que todas as questões de secretaria, papelaria, protocolos etc. Eram atribuição de setores específicos do escritório (e todos/as aqueles/as que começaram a advogar do zero ou perto disso sabem a dificuldade de sozinho operar todas essas questões).
Por uma outra coincidência do destino, tive a sorte de entrar nesse escritório logo quando ele mudou de sede, alojando-se na rua da Delegacia de Plantão da Zona Sul da capital do nosso estado (RN), fato que invariavelmente levou clientes criminais até a nossa porta. Nessa primeira semana, nos apareceu um senhor, o qual tinha perguntado ao porteiro do bairro onde poderia encontrar um advogado, oportunidade na qual indicou nossos serviços. O fato é que bateu à nossa porta um senhor procurando um criminalista e, ao ser encaminhado para o atendimento em minha sala, me confidenciou que era também advogado. Não atuava há muitos anos; havia montado uma empresa de conserto de calçados e construído a vida em outro sentido. Mas por tudo que detinha de conhecimento jurídico, e pelo senso de justiça que se lhe opunha à omissão, resolveu tomar à frente de uma situação que a priori não lhe cabia.
O marido de determinada funcionária da limpeza de uma de suas lojas havia sido flagrado furtando uma bicicleta velha e um par torado de chinelas havaianas. Em sede policial, alegou – sem advogado – que havia furtado ambos os objetos, pois estava longe de casa e havia ido fazer um serviço de mecânico (um “bico”) e quando chegou ao local combinado a pessoa esperada não se encontrava, ficando o mesmo sem ter como financiar sua volta para casa de ônibus. E quando chegou no Judiciário… O flagrante foi convertido em prisão preventiva, tendo como fundamento o fato de o mesmo não estar identificado civilmente (Art. 313, Parágrafo Único, CPP) e não possuir comprovação de residência fixa no distrito da culpa (acarretando o risco à Aplicação da Lei Penal, Art. 312 CPP).
Pasmem. O fato se deu em uma quinta-feira e a esposa somente soube do ocorrido três dias após, no sábado. Foram até a Unidade de Triagem, e não conseguiram falar com o rapaz, tendo em vista que o procedimento-padrão da localidade apenas permite a visita de familiares após 15 dias de “triagem”, e essa unidade por ser de “triagem” não permitiria visita alguma, a não ser de advogados. Frise-se: o tempo que se passa na unidade de “triagem” não é utilizado para abater o tempo de “triagem” quando o preso é transferido de uma unidade para outra. Mas isso é apenas um “parênteses”, então voltemos ao nosso ca (u) so.
No final de semana a família não conseguiu contatar ninguém, e na segunda, lá pelo fim da tarde, bateram à porta desse advogado que vos fala, a fim de tomar alguma providência. Em primeiro lugar, acertamos honorários e acordamos que aquele senhor apenas arcaria com o pedido de liberdade, e o próprio interessado, já em liberdade, tomaria a decisão de continuar ou não com essa defesa. Dito, conversado e acertado: fiz a consulta no sistema virtual do tribunal para me situar no processo e parti em busca do homem.
Fui, como esperado, até a Unidade de Triagem, para conversar com o cliente, me identificar e situá-lo brevemente dos próximos passos do processo. Ao chegar lá, a minha surpresa! Havia sido transferido… Achei estranho. Geralmente os presos levam de 15 até 20 dias, ou mais, para serem transferidos para outros Centros de Detenção Provisória (CDP’s) ou para a Cadeia Pública da Capital: e nesse caso não fazia nem uma semana.
É difícil explicar para o leitor de fora do Rio Grande do Norte a situação em que ora se encontra o Sistema Prisional do nosso estado, com Estado de Calamidade decretado a incríveis mais de 15 meses (e recentemente renovado por mais 6 meses): mas esse cenário pode explicar o que ocorreu. O quadro é de inúmeras situações difíceis, de rebeliões/motins a fugas e problemas generalizados com estrutura, recursos humanos e materiais, além do crime organizado com domínio absoluto do interior dos presídios, da massa carcerária e de suas famílias.
O que importa para nós é que estavam (e estão) acontecendo diversas transferências de presos por situações diversas ao que diz a nossa Lei, muitas vezes à mando da Administração Prisional sem comunicação com o Poder Judiciário, misturando presos de facções diferentes, que cometeram crimes diversos, e – como no caso que aflige essa reflexão – misturam os locais de custódia de presos provisórios e condenados.
Meu cliente havia sido transferido, sem autorização – nem muito menos comunicação – do Juiz das Execuções Penais competente, da família ou da defensoria, para um Presídio de Segurança Máxima (? – depois explico o por que dessa interrogação). Ele acabara de ser flagranteado e já estava em um Presídio de Segurança Máxima!
Me dirigi ao local, isso já na terça, e lá encontrei-o no Pavilhão de Triagem (difícil entender a razão de tantas “triagens”, não é?!), cadavérico, magro e com olheiras profundas, me relatando que havia fraquejado em um momento de estupidez, mas que estava arrependido e que nem seu pior inimigo merecia estar ali, estando ele há cinco dias sem comer, dormir ou tomar banho. Peguei a procuração e rapidamente voltei ao escritório para redigir a peça.
Apostei no pedido de primeiro grau (dispensei inicialmente o Habeas Corpus por já conhecer, há época, a fama de nossa – única – Câmara Criminal de [quase] nunca deferir essas liminares), e redigi a peça com toda a carga de conhecimento jurídico que pude, e, na quarta-feira, assim que pude, fui conversar com o Juiz. Não o conhecia, porém já tinha ouvido falar do perfil central e independente do magistrado. Pedi uma audiência com o mesmo, e apresentei os argumentos do absurdo que era manter aquele cidadão no dantesco sistema carcerário potiguar, ainda por cima por ele estar amargando sua custódia em um presídio de segurança máxima (sendo preso provisório), mesmo já estando identificado e com comprovação de residência fixa no distrito da culpa nos autos.
De pronto, o magistrado designou que seu assessor redigisse a minuta da decisão do pleito que então era apreciado, determinando a publicação da mesma com a consequente expedição do Alvará de Soltura. Esperei pacientemente a confecção desse bendito Alvará, acompanhando a remessa virtual do mesmo à COAPE (Coordenação de Administração Penitenciária), ocasião na qual segui o destino para lá.
Enquanto isso, já fui entrando em contato com o senhor que me contratou, para avisá-lo do êxito e informá-lo que se quisesse poderia ir se encaminhado ao Presídio, pois a ordem de soltura em breve chegaria também (tudo virtualizado, como se percebe). Ao chegar à COAPE, me certifiquei que havia chegado a ordem daquela Vara Criminal que acabara de visitar, e pude garantir o envio da mensagem até a Direção do Presídio.
Retornando ao escritório, com pouco tempo, me chegam os três. A jovem esposa aos prantos, sem acreditar que estava novamente aos braços do seu marido, o senhor (que me agradecia compulsivamente como se de fato fosse alguém da sua família que houvesse se implicado) e o então liberto mecânico, o qual emocionado e aos prantos, ao me ver da porta de entrada do escritório, deu um grito alto:
“Você me salvou, Doutor! Eu sabia!”
Após se acalmar um pouco, e concatenar suas palavras, disse que a situação de desgaste físico e mental estava no limite, por não conseguir conviver com o ambiente e tudo que acarretara, pensou em se matar diversas vezes, ou ainda arrefecer sua paranoia (que não o deixou inclusive dormir) e se deixar morrer. Pensou ainda que se não saísse a tempo ia ser obrigado a se integrar em alguma das facções atuantes por essas bandas, e assim estaria morto também. Não lhe restava outra saída. Com esse episódio, eu pude refletir sobre a profissão que escolhi para mim, e pude ver que cada vida que salvasse desse sistema brutal, por si só, valeria a escolha que fiz.
Após essa conversa, o casal afirmou que ia procurar a Defensoria por não possuir condições de arcar por conta própria com os honorários referentes ao acompanhamento até o final da ação penal e, assim, despediram-se (ao meu ver, com um semblante de gratidão indescritível que vale mais que qualquer pagamento). De tudo, com certeza, a maior lição desse dia foi minha. Foi a primeira vida que salvei.
