Na prática, a decisão proíbe que autoridades policiais prendam ou contenham práticas da mulher e do filho quando importarem sementes, cultivarem e produzirem maconha para fins exclusivamente medicinais. Além disso, os dois ficam autorizados a transportar materiais entre a casa onde vivem e o Instituto do Cérebro da Universidade Federal do Rio Grande do Norte, que ficará responsável por analisar a qualidade e os níveis seguros de utilização dos extratos.
O criminalista Gabriel Bulhões Nóbrega Dias considera que a liminar, assinada em novembro, é a primeira a reconhecer a importação de sementes para uso geriátrico e tratamento para mal de Parkinson. Os autores afirmam que, com a ingestão e a vaporização do extrato, a paciente ganhou “nova vida” e usa plenamente suas faculdades mentais, cognitivas e psicomotoras.
O problema, segundo eles, é que a família não tem condições de importar óleos prontos e corre o risco de ser alvo de inquérito por tráfico de drogas a cada importação de sementes. O juiz reconheceu então a compra e o cultivo da matéria-prima.

Ele também defendeu que criminalizar o uso de entorpecente para consumo próprio significa “a punição da autolesão” e “não está em compasso com o estado democrático constitucional, que tem como pedra de toque os direitos fundamentais”.
“Nem é preciso dizer que se está, aqui, fazendo apologia ao consumo de drogas ilícitas. Muito pelo contrário. O que se está dizendo é que art. 28 da Lei 11.343, de 2006, é inconstitucional em razão de criminalizar uma conduta que não lesiona bem jurídico alheio, o que é fundamental em um sistema criminal democrático”, escreveu.
