Há 30 anos que ela não é efetivada. Temos uma lei, que é o Estatuto da Advocacia, que tem regras claras de prerrogativas, de como as partes, o juiz, o promotor devem se comportar em relação ao advogado, e isso não vale nada”, criticou Carvalho.
“Temos regras no Código Penal, temos regras no Código de Processo Penal que eram claras até poucos dias atrás e hoje são flexibilizadas e violadas sem o mínimo pudor. É preciso caminhar para um sistema acusatório e possibilitar a defesa”, sustentou o paranaense. “No dia a dia nas delegacias, o advogado é tratado como um estorvo, e quem deveria estar fazendo o controle não o faz. É preciso tratar a investigação criminal defensiva como garantia fundamental. É preciso trazer isso para uma esfera de lei”, disse.
