O Conselho Federal da Ordem dos Advogados do Brasil (OAB) aprovou o provimento que regulamenta bases para o advogado fazer investigação e presidir inquérito defensivo. A norma define algumas condutas na apuração de provas, de oitivas de vítimas e testemunhas. Além disso, assegura ao advogado acesso a provas, informações, certidões públicas e notificacões judiciais tanto do Código de Processo Penal como do Código de Processo Civil.
O projeto tem abrangência nacional, e foi maturado no Rio Grande do Norte por uma comissão formada pelo advogado Gabriel Bulhões, ao longo de 2016. Presidente da Comissão de Advogados Criminalistas da OAB-RN, Gabriel co-assina a proposta com o presidente da Ordem no Estado Paulo Coutinho, enviado em 2017. O presidente da comissão, explica que o provimento busca evitar que a advocacia tenha um papel protocolar antes do fim da “lava jato”.
O projeto teve a participação do professor Edson Luís Baldan (PUC/SP); Paulo Coutinho (OAB/RN); Aurino Giacomelli e André Saraiva (Conselheiros Federais pela OAB/RN). Todos os membros da COMACRIM-OAB/RN, Hugo Fernandes; e ainda, Cassio Telles (PR); Flávio Pansieri (PR); Juliano Breda (PR); Raimundo Palmeiras (AL); Nilson Araújo (TO); Aquiles Perazzo (ABRACRIM/RN); Rodrigo Oliveira de Camargo (RS) e Cristiano Maronna (IBCCRIM).
De acordo com o advogado, a ideia já foi implementada na Itália há alguns anos e funcionou como um refluxo da operação “Mãos Limpas”, apontada como inspiração da “lava jato”. “Foi no final dessa operação que a advocacia criminal se deu conta que exerceu um papel meramente protocolar. Aqui, estamos tentando antecipar esse processo histórico”, disse o advogado.
Gabriel explicou que a regulamentação fará com que “advogados de gabinete saiam da zona de conforto, e deixem de apenas reagir à ação estatal”. Ele acrescenta que a proposta abre novas frentes, “desde que sejam respeitadas normas constitucionais, as leis e a ética”, e traz como pano de fundo uma mudança de cultura e de paradigmas tanto na advocacia, quanto no sistema judiciário e na sociedade, que passa a ter mais um recurso de fazer valer seus direitos e interesses.
Bulhões contou que, em 2017, a comissão promoveu um curso sobre investigação defensiva e depois disso instituiu um grupo de trabalho para estudar o tema. E estudo resultou num projeto que foi anexado a uma minuta de provimento como sugestão para ser apresentado ao Conselho Federal da Ordem.
“A investigação defensiva traz possibilidade de autonomia à advocacia com relação ao trabalho estatal. Eventualmente, se for do interesse da defesa, ela pode antecipar e trazer para conhecimento da autoridade policial o que foi apurado – sendo que o material apresentado pode, ou não, ser acatado. É importante frisar que quem preside o inquérito é a autoridade policial, quem preside o PIIC (Procedimento Interno =de Investigação Criminal) é o promotor, e quem preside a investigação defensiva é o advogado. O curso, o desenvolvimento, o rumo, as diligências a serem adotadas, e/ou o momento de comunicar às autoridades o que foi apurado é estritamente decisão do advogado em conjunto com o cliente”, explicou Bulhões.
Pouco difundida no Brasil, a investigação defensiva, que em essência defende os interesses de uma das partes em determinado processo, é um recurso comum nos Estados Unidos.
